Terms and Conditions

1. Scope of Application

  1. These Terms and Conditions apply to all contracts concluded between Nihilistic Empire - AMP Studio - Niersstr. 19 - 47169 - Duisburg - Email: info@dtf-4u.com - Tel: +49 203 71886376 (hereinafter “Seller”) and consumers (§ 13 BGB) via the online shop.
  2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.
  3. Deviating terms and conditions of the customer shall not be recognized unless the Seller expressly agrees to their validity in writing.

2. Conclusion of the Contract

  1. The products displayed in the online store do not constitute a legally binding offer, but rather a non-binding invitation to place an order.
  2. By clicking the “Buy Now” button or a similarly labeled button, the customer submits a binding offer to conclude a purchase contract.
  3. The seller will immediately confirm receipt of the order via email. This confirmation of receipt does not yet constitute acceptance of the offer.
  4. The contract is only concluded through: an express order confirmation or the shipment of the goods.

3. Prices and Payment Terms

  1. All prices include applicable sales tax.
  2. Any additional shipping costs will be shown separately during the ordering process.

  4. The purchase price is due immediately upon conclusion of the contract.

4. Delivery and Shipping

  1. Delivery will be made to the shipping address provided by the customer.
  2. Delivery times are specified in the respective offer.
  3. If an ordered product is unavailable, the customer will be notified immediately. Any payments already made will be refunded immediately.
  4. Partial deliveries are permitted, provided they are reasonable for the customer.

5. Retention of Title

The goods remain the property of the seller until full payment has been made.

6. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. Information regarding the right of withdrawal, as well as the model withdrawal form, will be provided to the customer separately and are part of the statutory consumer information.

7. Warranty

  1. The statutory rights regarding liability for defects apply.
  2. The customer is requested to report any obvious transport damage to the delivery company as soon as possible and to inform the seller thereof. This does not affect the customer’s statutory rights.

8. Liability

  1. The seller is fully liable: in cases of intent and gross negligence, in cases of injury to life, limb, or health, in accordance with the provisions of the Product Liability Act.
  2. In the event of a slightly negligent breach of material contractual obligations, the seller is liable only for foreseeable damage typical for this type of contract.
  3. Otherwise, liability is excluded to the extent permitted by law.

9. Gift Cards

  1. Gift cards can only be redeemed within the specified validity period.
  2. Cash redemption of voucher balances is excluded, unless required by law.
  3. Vouchers can only be redeemed before completing the order process.

10. Online Dispute Resolution

The European Online Dispute Resolution (ODR) platform has been discontinued. The seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by law.

11. Governing Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. With respect to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

12. Final Provisions

Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
